In court, asset values are set by expert reports — paid by the parties and challenged in turn — and if division in kind is impossible, the judge may order an auction. In mediation, the parties choose a single valuator together, and the solutions can be as fine-grained as needed: one keeps the house with instalment payments, another takes the land and the cash, the family home stays unsold until the children finish university.
Real-estate division agreements are authenticated by the notary, who also handles the land-registry registration — with full legal effect. And if the partition case was already in court, the stamp duty may be refunded under art. 63 of Law no. 192/2006 — note, however, that the law provides exceptions, including agreements involving the transfer of real-estate ownership.
