Mediation can be organised remotely, by videoconference, in compliance with the rules applicable to the procedure and with the same confidentiality guarantees. Documents can be signed electronically, under the conditions of the electronic signature legislation, and for documents that require a specific form — including some agreements concerning real estate, property division or inheritance — the notarial or judicial formalities provided by law are required. In cross-border disputes, the agreement may be submitted to the procedures for obtaining enforceability provided by the law of the relevant state, within the framework of Directive 2008/52/EC.
We work routinely in Romanian and English, including "mixed" mediations with one Romanian and one foreign party. Sessions are scheduled on each party's time zone — evenings for Canada, mornings for Romania — and documents move electronically, not by courier between three countries.

The context

Four video sessions across six weeks, scheduled in the evening to bridge the time zones. A valuation accepted by all, then the takeover of the building by one heir with staged payments to the other two.
The result
Agreement signed at the notary through representation — two of the siblings never travelled to Romania. The inheritance closed in under two months.
